Abstract – Summary and Keywords

The Author focuses on abuse in sport, especially against minors, and offers a review of the main International and European legal and non-legal instruments available to tackle this hateful and intolerable plague. In particular, the Author’s analysis is centered on the safeguarding policies adopted both at International level by the International Olympic Committee (IOC), and, more recently, at national level and on the importance of raising awareness on abuse in sport and educating people to deal with it.

Classificatasi al secondo posto del Premio RDES per la migliore tesi di laurea discussa nell’anno 2023, dal titolo “Lo sfruttamento commerciale dell’immagine degli sportivi”, di cui il presente elaborato rappresenta un estratto.

Il presente contributo analizza la disciplina del diritto di immagine dell’atleta, alla luce delle disposizioni dell’ordinamento generale contenute nel codice civile e delle prescrizioni dell’ordinamento sportivo, attorno al quale gravitano esigenze specifiche – collegate alla struttura dell’organizzazione sportiva e alle richieste del mercato dello sport – che impongono talora delle restrizioni all’atleta in ordine alla libertà di utilizzo della propria effige. In questa intersezione di interessi, vedremo come l’immagine dell’atleta, per un verso, subisce limitazioni dal sistema sportivo, dall’altro viene valorizzata proprio dall’appartenenza a quest’ultimo, moltiplicando le possibilità di sfruttamento commerciale e di relativo guadagno.

Abstract – Summary and Keywords

The paper focuses on the protection of human rights of non-binary athletes (transgender athletes and athletes with sex variations). Starting from the Semenya case and the ruling of the European Court of Human Rights, the Author analyses the most recent initiatives adopted by the sports movement, i.e. International Olympic Committee (IOC) and International Federations (IFs). In particular, the Author underlines the complexity of the issue at hand and the importance of tackling it with an approach free from any ideological prejudice.
